Rubbish Clearance Catford Service Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Clearance Catford provides rubbish clearance and waste collection services. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
These terms apply to all domestic and commercial customers engaging us to collect, remove, transport or dispose of waste materials. They form a contract between you and Rubbish Clearance Catford once a booking is confirmed.
Definitions
In these Terms and Conditions, the following expressions have the meanings set out below.
Company, we, us or our means Rubbish Clearance Catford, the provider of rubbish clearance and waste collection services.
Customer, you or your means the person, business, firm or organisation making a booking with us or otherwise using our services.
Services means any rubbish clearance, waste collection, removal, loading, transportation, recycling, disposal or associated services provided by us.
Waste means any items, materials, goods or substances that you ask us to remove, collect or dispose of as part of the Services.
Site or Premises means the location where the Waste is to be collected or where the Services are to be performed.
Scope of Services
We offer a range of rubbish clearance and waste collection services including, but not limited to, household rubbish removal, garden waste clearance, bulky item collection, office and commercial waste collections, and general waste disposal services.
The exact scope of the Services for each booking will be agreed with you in advance, based on the information you provide about the type and quantity of Waste, access to the Site and any special requirements. We reserve the right to refuse or amend the Services where the Waste is different to that described at the time of booking, where access is unsafe, or where the work falls outside our usual service capability.
Booking Process
You may request a quotation and make a booking with us by telephone, email or online contact form where available. When requesting a quotation, you must provide accurate and honest information about the type, condition, and approximate volume or weight of the Waste, as well as details of access, parking, and any restrictions at the Site.
Any quotation provided by us is based on the information you supply and is an estimate only. We reserve the right to revise the quotation if the Waste or Site conditions materially differ from your description.
Your booking is provisional until it has been confirmed by us. A contract between you and us is formed when we confirm acceptance of your booking by telephone, email, text message or other written confirmation. We may, at our discretion, request a deposit or pre-payment as a condition of confirming the booking.
You are responsible for ensuring that your contact details are correct and that you are available at the agreed time to grant access to the Site. If you are not personally present, you must appoint an authorised representative to be on Site and able to make decisions on your behalf.
Access and Site Requirements
You must ensure that we have safe, adequate and lawful access to the Site at the agreed time of collection. This includes providing any necessary entry codes, keys, permissions, parking arrangements, or permits required for our vehicle and crew to operate lawfully and safely.
You must ensure that the Waste is reasonably accessible and is not mixed with items that you wish to keep. We accept no liability for items that are removed in error where they have not been clearly segregated or identified as items to be retained.
If access to the Site or the Waste is blocked, hazardous, significantly restricted or otherwise unsuitable, we may cancel or rearrange the booking, or apply additional charges to reflect any waiting time, additional labour or alternative methods required.
Waste Types and Restrictions
We provide rubbish clearance and waste collection services for most common household and commercial waste types, including general rubbish, furniture, appliances, garden waste and non-hazardous building materials.
We do not normally accept hazardous, specialist or regulated waste unless expressly agreed in writing in advance. This includes, but is not limited to, asbestos, clinical or medical waste, chemicals, solvents, oils, fuel, gas bottles, pressurised containers, explosives, radioactive materials, and certain electrical or electronic items subject to specific disposal controls.
You must inform us before the booking if any Waste is hazardous, contains sharp or dangerous components, or is subject to any special handling or disposal requirements. We reserve the right to refuse to remove any Waste which we reasonably believe to be unsafe, illegal, or outside the scope of our licence or capabilities.
If we discover, after commencement of the Services, that the Waste includes prohibited items, we may suspend work, remove only permitted Waste and charge for any additional time spent. Any prohibited items will remain your responsibility, and you must arrange suitable disposal in accordance with applicable regulations.
Waste Handling and Duty of Care
We are committed to carrying out rubbish clearance and waste collection services in compliance with all applicable waste management laws and regulations in the United Kingdom, including duty of care obligations under relevant environmental legislation.
Once the Waste has been collected and loaded into our vehicle, it becomes our responsibility, and we will transport it to an appropriate licensed facility for reuse, recycling or disposal, as appropriate. We may segregate the Waste to maximise recycling and reduce landfill disposal where reasonably practicable.
By using our Services, you confirm that you have the legal right to transfer the Waste to us and that the Waste does not include any items that are stolen, unlawfully obtained, or otherwise the property of a third party without their consent.
Pricing and Payments
Our charges are generally based on the volume or weight of Waste collected, the type of Waste, the labour involved, access conditions, and any additional services you request such as dismantling or extra loading time.
We will provide you with an estimated price at the time of booking based on the information you provide. The final price will be confirmed on Site once our crew has inspected the Waste and access conditions. If the actual Waste or conditions significantly differ from your description, we will advise you of any change to the price before commencing work.
Payment is due in full on completion of the Services unless we have agreed alternative payment terms in writing. We accept payment by cash, bank transfer, debit card or credit card, subject to any applicable surcharges or minimum charges.
For business customers with approved accounts, invoices are payable within the timeframe stated on the invoice. We reserve the right to charge interest and reasonable recovery costs for overdue invoices in line with applicable UK legislation.
Cancellations and Amendments
You may cancel or amend your booking by contacting us as soon as possible. If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will usually be charged. If you cancel within 24 hours of the booking, or if our crew attends Site and is unable to complete the Service due to your act or omission, we may charge a call-out fee or a percentage of the quoted price to cover our costs.
We will make reasonable efforts to accommodate requests to change the date, time or scope of the booking, but this will depend on availability and may result in a change to the quoted price.
We reserve the right to cancel or reschedule a booking in the event of vehicle breakdown, staff illness, severe weather, safety concerns, or other circumstances beyond our control. In such cases, we will endeavour to notify you as soon as reasonably possible and offer an alternative appointment. We will not be liable for any losses arising from such cancellations or delays.
Customer Responsibilities
You are responsible for:
Ensuring all information provided at the time of booking is accurate and complete.
Obtaining any necessary permissions, consents or permits for access and parking at the Site.
Ensuring safe access to the Waste and that the Site is reasonably safe for our crew to operate.
Separating and clearly identifying any items that you do not intend to be removed.
Ensuring that the Waste is free from hazardous, prohibited, or unlawful materials unless previously disclosed and agreed.
Complying with all applicable laws and regulations relating to the Waste and the Premises.
Our Responsibilities
We will provide the Services with reasonable skill and care, and in accordance with applicable waste regulations and our waste carrier obligations. We will make reasonable efforts to arrive within the agreed time slot, although timings are approximate and may be affected by traffic, weather and operational factors.
Our crew will act professionally and will take reasonable care to avoid damage to your property when carrying out the rubbish clearance or waste collection. However, you acknowledge that some risk of minor scuffs or marks may be unavoidable where large or heavy items are being removed from confined spaces.
Liability and Limitations
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under UK law.
Subject to the above, our total liability to you for any loss or damage arising out of or in connection with the Services, whether in contract, tort, negligence or otherwise, shall be limited to the total amount actually paid by you for the specific booking giving rise to the claim.
We shall not be liable for any indirect, consequential, special or economic loss, including but not limited to loss of profit, loss of business, loss of opportunity, or loss of data.
We accept no responsibility for items removed where they were not clearly designated as items to be retained. You should check all areas and confirm which items are to be removed before work commences.
We shall not be liable for any delay or failure to perform our obligations where such delay or failure is caused by events beyond our reasonable control, including but not limited to accidents, traffic conditions, severe weather, fire, flood, industrial action, or acts of government.
Insurance
We maintain appropriate insurance cover for our rubbish clearance and waste collection operations, including public liability cover. Details of our insurance can be provided upon reasonable request.
You are responsible for maintaining any insurance you consider necessary for your own property and belongings at the Site. You should ensure that valuable or fragile items are moved or protected before our crew begins work.
Complaints and Disputes
If you are dissatisfied with any aspect of our Services, you should notify us as soon as reasonably possible so that we have an opportunity to discuss and, where appropriate, rectify the issue.
We will aim to handle complaints fairly and promptly. You agree to cooperate with us and provide any relevant information we reasonably request to investigate the matter.
Any dispute arising out of or in connection with these Terms and Conditions or the Services will first be discussed in good faith between the parties with a view to reaching an amicable resolution. If a dispute cannot be resolved informally, either party may pursue its rights through the courts of England and Wales.
Data Protection and Privacy
We collect and process personal data such as your name, contact details, address, and information relating to your booking to provide the Services and manage our relationship with you. We will handle your personal information in accordance with applicable UK data protection laws.
We will not sell your personal data to third parties. We may share your information with trusted partners or subcontractors where necessary to deliver the Services, comply with our legal obligations, or enforce these Terms and Conditions.
Variation of Terms
We may update or amend these Terms and Conditions from time to time to reflect changes in our operations, services, pricing structure, or applicable law. The version in force at the time of your booking will apply to that booking.
Any changes to these Terms and Conditions will be made available on request. Continued use of our Services after such changes have been communicated will constitute your acceptance of the updated terms.
Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.
Entire Agreement
These Terms and Conditions, together with any written quotation or confirmation provided by us, constitute the entire agreement between you and Rubbish Clearance Catford in relation to the Services. You acknowledge that you have not relied on any statement, promise or representation not expressly set out in these Terms and Conditions.
By confirming a booking or allowing our crew to commence work, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
